# Terms of Use **TrackedTalk** is a product of **Revyst (Pty) Ltd** (Reg: K2026479705) **Effective date:** 1 July 2026 **Last updated:** 1 July 2026 --- ## 1. Introduction These Terms of Use ("Terms") govern your access to and use of TrackedTalk, a sales call performance tracking platform developed and operated by Revyst (Pty) Ltd ("we", "us", "our"). By accessing or using TrackedTalk, you agree to be bound by these Terms. If you do not agree, you may not use the platform. --- ## 2. The Platform TrackedTalk is a web-based platform that enables client organisations to track and manage the call activity, performance, and follow-up behaviour of their internal sales teams. Features include call logging, contact management, manager dashboards, performance reporting, and rep accountability tools. --- ## 3. Access and Accounts - Access to TrackedTalk is granted to authorised users on behalf of a subscribing client organisation - You are responsible for maintaining the confidentiality of your login credentials - You may not share your account credentials with any other person - You must notify us immediately at info@revyst.com if you suspect unauthorised access to your account - We reserve the right to suspend or terminate access where we reasonably believe these Terms have been breached --- ## 4. Acceptable Use You agree to use TrackedTalk only for its intended purpose of internal sales performance tracking. You must not: - Use the platform for any unlawful purpose or in violation of any applicable South African law - Attempt to gain unauthorised access to any part of the platform or its underlying infrastructure - Upload or transmit any malicious code, viruses, or harmful content - Reverse engineer, decompile, or attempt to extract the source code of the platform - Use the platform to store or process special personal information as defined under POPIA without appropriate safeguards - Resell, sublicense, or otherwise make the platform available to third parties outside your organisation without written consent from Revyst (Pty) Ltd --- ## 5. Data and Privacy Your use of TrackedTalk involves the processing of personal information. Our collection and use of personal information is governed by our **Privacy Policy**, which forms part of these Terms and is available at trackedtalk.com/privacy. As the client organisation, you remain the responsible party for all personal information processed within your TrackedTalk account and are responsible for ensuring your use of the platform complies with POPIA and all other applicable legislation. --- ## 6. Call Recordings Where your organisation integrates TrackedTalk with a VoIP or softphone system and call recordings are stored within the platform, you confirm that: - All parties to recorded calls have been informed of and consented to the recording - Your organisation complies with all applicable South African legislation regarding call recording, including RICA - Revyst (Pty) Ltd bears no liability for any failure by your organisation to obtain the necessary consents or comply with applicable recording laws --- ## 7. Intellectual Property - TrackedTalk, including all software, designs, content, and documentation, is the intellectual property of Revyst (Pty) Ltd and its founders - Your subscription grants you a limited, non-exclusive, non-transferable licence to access and use the platform for your internal business purposes only - Nothing in these Terms transfers any intellectual property rights to you --- ## 8. Service Availability - We aim to maintain platform availability at all times but do not guarantee uninterrupted access - Scheduled maintenance will be communicated in advance where reasonably practicable - We reserve the right to suspend access temporarily for maintenance, security, or technical reasons - Revyst (Pty) Ltd is not liable for losses arising from temporary platform unavailability --- ## 9. Limitation of Liability To the maximum extent permitted by applicable South African law: - Revyst (Pty) Ltd's total liability to you in connection with your use of TrackedTalk shall not exceed the total fees paid by your organisation in the three months preceding the event giving rise to the claim - We are not liable for any indirect, consequential, or special damages, including loss of profit, loss of data, or loss of business opportunity - We are not responsible for decisions made by your organisation based on data or reports generated within the platform --- ## 10. Termination - Either party may terminate access to TrackedTalk by providing written notice in accordance with the Client Services Agreement - Upon termination, your organisation's data will be retained for 30 days during which you may request an export, after which it will be permanently deleted - Provisions of these Terms that by their nature should survive termination will continue to apply --- ## 11. Governing Law These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of TrackedTalk will be subject to the jurisdiction of the South African courts. --- ## 12. Changes to These Terms We may update these Terms from time to time. Where changes are material, active users will be notified via email. Continued use of TrackedTalk after updated Terms are published constitutes acceptance of the revised Terms. --- ## 13.
